1. Acceptance
By accessing rtscale.ai (the "Site") you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Site. RTSCALE.AI, Inc. ("RTScale," "we," "our," "us") may update these Terms; continued use after notice of a change constitutes acceptance.
2. Scope of these terms
These Terms govern your use of the marketing website at rtscale.ai, including its contact and demo request forms. They do not govern the RTScale SDK, API, or any partner integration — those are governed by separate Master Services Agreements and Data Processing Agreements between RTScale and the relevant integration partner.
3. Permitted use
You may access and use the Site to:
- Learn about RTScale's products and services.
- Submit a contact or demo request via the forms provided.
- Download linked resources (developer briefs, compliance summaries).
You may not:
- Use automated tools to scrape, crawl, or systematically download content from the Site without prior written permission.
- Submit false, misleading, or spam content through the contact or demo request forms.
- Attempt to probe, scan, or test the security of the Site's infrastructure without authorization. Authorized security research is welcome — contact us through the vulnerability disclosure process in the Trust Center.
- Reproduce, redistribute, or commercially exploit Site content without prior written consent.
4. Intellectual property
RTScale™, State of Mind™, SoM™, State of Mind Model™, SoMM™, State of Mind Methodology™, State of Mind Signature™, and SoM Sig™ are trademarks of RTSCALE.AI, Inc. Trademark applications are pending. All other content on the Site — text, design, graphics, and code — is the property of RTScale or its licensors and is protected by copyright and other applicable law.
Nothing in these Terms grants you a license to RTScale's trademarks, patents, or other intellectual property except the limited right to use the Site as described in §3.
5. Disclaimers
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
Content on the Site describes RTScale's products and commercial positioning as of the effective date above. It does not constitute legal, financial, compliance, or clinical advice. Regulatory citations are provided for informational context; you should obtain independent advice from qualified counsel for your specific jurisdiction and situation.
RTScale does not warrant that the Site will be uninterrupted, error-free, or free of harmful components.
6. Limitation of liability
To the maximum extent permitted by applicable law, RTScale shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Site, even if RTScale has been advised of the possibility of such damages.
RTScale's total liability to you for any claim arising from these Terms or use of the Site shall not exceed one hundred US dollars (USD $100).
7. Privacy
Use of the Site is also governed by our Privacy Policy, which is incorporated by reference into these Terms.
8. Changes to these terms
We may update these Terms at any time. Material changes will be posted with an updated effective date. Continued use of the Site after the effective date of a change constitutes acceptance of the updated Terms. If you object to a change, stop using the Site and contact us.
9. Governing law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles. Any dispute arising under or relating to these Terms shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction and venue in those courts.
